REX Privacy Policy

REX values the privacy of individuals who use our website and related services (collectively, our “Services”). Please read the following to learn more about our privacy policy (the “Privacy Policy”), which explains how we collect, use, and share information from or about users of the Services (“Users”) or their devices. By using or accessing our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Remember that your use of REX's Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy.

The terms “REX”, “we”, “our” and “us” includes REX – Real Estate Exchange, Inc. dba California First Escrow and our affiliates and subsidiaries, including REX Insurance Group, LLC, REX Home Loans, LLC, REX Home Care, LLC, Iron Crest National Holdings, LLC, Iron Crest National Title Agency, LLC, Iron Crest National Title Agency of the West, LLC, Iron Crest National Title, LLC, Iron Crest National Title Agency of Utah, LLC, and Iron Crest National Title Company.

Information We Collect

We collect a variety of information from and about you and your devices from various sources, as described below. If you do not provide your information when requested, you may not be able to use our Services if that information is necessary to provide the Services or if we are legally required to collect it.

INFORMATION YOU PROVIDE TO US

Registration and Profile Information. If you sign up for an account or register on our Services, we may ask you to create a username, password, and answer a security question. We also may ask you for your name, email address, phone number, and any other information we collect.

Communications. If you contact us directly, we may receive additional information about you. For example, when you contact us for support or to make an offer, we may receive your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services. If you communicate with us by telephone, we may monitor or record the call for quality and training purposes, to maintain the integrity of your account, and to improve the customer experience.

Pre-Approval for a Home Purchase Mortgage. If you submit information for pre-approval for a home purchase mortgage, then we will collect certain information from you, such as your name, current home address, home address that you are taking a mortgage out on, email address, phone number, date of birth, social security number, marital status, number of dependents and their ages, homeowner or renter status, language preference, race, ethnicity, sex, citizenship status, military service information, employment information, salary information, checking account information, estimated income, assets, and liabilities information, and any other information we request from you.

Loan Applications. If you apply for a mortgage loan, then we will collect certain information from you, such as your name, social security number, marital status, number of dependents, the amount and source of your down payment, employment and income information, asset and liability information, current deposit accounts, current and past consumer credit accounts, credit scores, your mortgage and/or rental history, and any other information we request from you. As required by law, we ask for borrower demographic information to help ensure that all applicants are treated fairly and that the housing needs of communities and neighborhoods are being fulfilled. If you choose to provide such information, we will receive your demographic information, including your ethnicity, sex, and race in order to monitor compliance with equal credit opportunity, fair housing, and home mortgage disclosure laws.

Refinancing or Taking Out a Home Equity Line of Credit. If you contact us to refinance your home, then we will collect certain information from you, such as your name, email address, phone number, date of birth, social security number, marital status, number of dependents, current home address that you are refinancing or taking a line of credit out on, estimated property value, requested line of credit amount, planned use of the funds, language preference, race, ethnicity, sex, citizenship status, military service information, employment information, salary information, checking account information, estimated income, assets, and liabilities information, and any other information we request from you.

Insurance Quotes. If you request an insurance quote, then we will collect certain information from you, such as your name, email address, phone number, date of birth, current home address that you would like to insure, and any other information we request from you.

Home Services. If you request home services, then we will collect certain information from you, such as your name, email address, phone number, details about your home, and any other information we request from you in order to provide quotes and services.

In-Home Consultations. If you request an in-home consultation, we will collect certain information from you, such as your name, email address, phone number, and any other information we request from you.

If you provide us any other information via applications, forms, surveys, or other online fields, we will collect that information.

INFORMATION WE COLLECT AUTOMATICALLY WHEN YOU USE OUR SERVICES

Device Information. We receive information about the device and software you use to access our Services, including internet protocol (“IP”) address, web browser type, operating system version, and mobile advertising identifiers.

Usage Information. To help us understand how you use our Services and to help us improve them, when you use our Services, we automatically receive information about your interactions with our Services, like the pages or other content you view, pages you request, the websites you visited before using our Services, and the dates, times and duration of your visits.

Location Information. When you use our Services, we infer the general physical location of your device and the geographic regions our Users come from. For example, your IP address may indicate your general geographic region.

Information from Cookies and Similar Technologies. We and third-party partners collect information using cookies, pixel tags, or similar technologies. Our third-party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.

Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device. Please review your web browser’s “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete or choose not to accept cookies from the Services, you may not be able to utilize the features of the Services to their fullest potential.

INFORMATION WE RECEIVE FROM THIRD PARTIES

Other Users. If you are a co-borrower or dependent of one of our Users who has applied for a loan through our Services, we may receive information about you through the loan application process.

Consumer Reporting Agencies. To provide loans, we receive information about you from consumer reporting agencies to assess your creditworthiness and to prevent fraud and identity theft. The reports we receive from consumer reporting agencies may include information about your open and closed credit accounts, monthly balances and payments, credit inquiries, late payments, collection actions, bankruptcy judgments, credit score, and transaction history.

Government Entities. We receive information about you from government entities, such as federal, state, or local tax or governmental authorities.

In Connection with a Transaction. In furtherance of transactions related to our Services, we receive information about you directly from third parties, including real estate sales agents and brokers, mortgage companies and lenders, title companies, contractors, bookkeepers and accountants, tax preparers, attorneys, notaries, homeowner’s associations, or insurance agents.

Information from Third-Party Services. If you choose to link your account on our Services to a third-party account, we may receive information about you, including your name, location, and any video or image content that you make available. Your account privacy settings may allow you to limit the other users who can see the Personal Information in your user profile and/or what information in your user profile is visible to others. You may post photos, comments, or reviews on our pages available through third-party platforms, including Facebook, Instagram, Twitter, or LinkedIn. If you do so, we and other users may be able to view the information you make available through these third-party platforms.

Other Third Parties. We may receive additional information about you from third parties such as data or marketing partners and combine it with other information we have about you.

How We Use the Information We Collect

We use the information we collect:

  • To allow you to set up a user account and profile;
  • To process your application for a loan or refinancing and conduct interim servicing on your account or loan;
  • To provide quotes for insurance, home services, and other services that you request;
  • To provide, maintain, improve, and enhance our Services, such as speeding up our website and recognizing when you return to our Services;
  • To communicate with you, provide you with updates and other information relating to our Services, fulfill your requests for certain products and services, provide information that you request, respond to comments and questions, and otherwise provide customer support;
  • To contact you and allow other users to contact you;
  • For marketing purposes, such as developing and providing promotional and advertising materials that may be useful, relevant, valuable or otherwise of interest to you;
  • To send you text messages;
  • To facilitate transactions, payments, billing, and collection;
  • To de-identify and aggregate information collected through the Services and use it for any lawful purpose;
  • To find and prevent fraud, and respond to trust and safety issues that may arise, including protecting the rights, property, or safety of REX, our Users, or others;
  • For compliance purposes, including enforcing our legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency, including to respond to any government or regulatory request; and
  • For other purposes for which we provide specific notice at the time the information is collected.

How We Share the Information We Collect

We may share or otherwise disclose information we collect from or about you as described below or otherwise disclosed to you at the time of collection.

Affiliates. Our entities and affiliates that are not financial institutions or have collected information outside of the relationship of providing financial services or products may share non-financial information about you with REX-affiliated companies, such as title insurers, property and casualty insurers, and trust and investment advisory companies, or companies in real estate services, such as appraisal companies and home warranty companies, to provide related offers, products, and services that may be of interest to you or to manage and improve our Services as permitted under applicable law or otherwise disclosed to you at the time we collect this information. Financial Business Partners. In certain situations, we may share information about you to nonaffiliated third-party business partners, as permitted by law or with your consent. We will provide information to allow you to recognize when a business partner is associated with such a transaction or service, and we will share information about you with that business partner to the extent related to the transaction or service.

Home Services Partners. We may share certain information, such as name, email address, property address, and other information about the property, about you to nonaffiliated third-party partners who provide home improvement services, including remodeling, repair, maintenance, painting, and moving services that may be of use to you.

Vendors and Service Providers. We may share any information we receive with agents, vendors, and service providers retained to perform tasks on our behalf in connection with the provision of our Services or the services of the vendor/service provider. We may also provide information we receive to service providers that perform marketing services on our behalf, on behalf of our affiliated companies, or to financial institutions with whom we or our affiliated companies have joint marketing agreements.

Other Lending Entities and Third Parties Needed to Complete Your Transaction. We may share certain information we receive about you in connection with your loan or refinancing application with credit reporting agencies, underwriters, mortgage companies and lenders, insurance agents, homeowners associations, attorneys, bookkeepers and accountants, notaries, real estate agents and brokers, contractors, structural pest control operators, financial institutions, and other similar entities as necessary to process your application, originate and service your loan, or render services to you or the real property or business that is the subject of your transaction.

Government Entities and Financial Institutions. We may share certain information we receive about you in connection with loans that we issue with federal and state government entities or financial institutions which may purchase, insure, or service the loan after funding.

Analytics Partners. We use analytics services such as Google Analytics to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. You can learn about Google’s practices by going to www.google.com/policies/privacy/partners, and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at tools.google.com/dlpage/gaoptout.

Other Users. The Services may include social networking functionalities that allow you to, upon your direction, interact and communicate with other Users. If you choose to use such functionalities to share information with other Users, the content you post to the Services will be viewable by other users by default. We are not responsible for the other Users’ use of available information, including through discussion boards, in messages, and chat areas, so you should carefully consider whether and what to post or how you identify yourself on the Services.

As Required by Law and Similar Disclosures. We may access, preserve, and disclose information about you if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers. We may disclose and transfer information about you to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our business or assets.

Consent. We may also disclose information from or about you or your devices with your permission.

Your Rights and Choices

Account Information. Through your account settings, you may access, and, in some cases, edit or delete certain information you have provided to us, including your name and password, email address, home address, and user profile information such as images and videos you have uploaded to our Services. The information you can view, update, and delete may change as the Services change. Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt out of receiving promotional messages from us, you will continue to receive administrative messages from us.

Financial Product Customers. If you obtain financial products from our entities that are financial institutions, such as home loan or escrow services, the Consumer Privacy Notice also applies to our processing of information about you in connection with such financial products.

California Residents. If you are a California resident, you may exercise certain rights by submitting requests to know and access the personal information we have collected about you, to delete personal information, to opt out of the sale of personal information, and to not be discriminated against for exercising these rights. If you choose not to provide us with information we collect, some features of our Services may not work as intended.

Third Parties

Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any information you disclose to these third parties. We are not responsible for the privacy practices or the content of such sites. If you have any questions about how these other sites use information from or about you, you should contact them directly. We encourage you to read their privacy policies before providing any information to them.

Security

Your account is protected by a password for your privacy and security. You are responsible for preventing unauthorized access to your account by selecting and protecting your password (and/or other sign-on mechanism) appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.We make reasonable efforts to protect information from or about you by using technical and organizational safeguards designed to improve the security of the information we maintain. However, as our Services are hosted electronically, we can make no guarantees as to the security or privacy of your information.

Children's Privacy

We do not knowingly collect, maintain, or use personal information from children under 16 years of age, and no part of our Services are directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, please alert us at hello@rexhomes.com.

International Visitors

Our Services is hosted in the United States and intended for visitors located within the United States. If you choose to use our Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring information from or about you or your devices outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including information from or about you or your devices, on or to the Services, you consent to such transfer, storage, and processing.

Changes to this Privacy Policy

We're constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well. We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective as of the last updated date herein. If we materially change the ways in which we use or share information from or about you or your devices previously collected from you through the Services, we will make reasonable efforts to alert you to the changes by sending a notice to the primary email address provided to us and/or by placing a notice on our Services. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.
